NEW YORK (1010 WINS) -- A Bronx woman who had three children taken away by ACS has been charged with murder.

However, the agency didn't take away her 5-month-old son and he is dead.

Police said they found the lifeless body of Raymond Porfil in his crib in his mother's 13th-floor apartment at the Bronx River Houses in Soundview on June 4.

His mother, Joann McLeod, 30, is accused of throwing Raymond against a wall.

Rayond had fractures and bruises all over his little body, 1010 WINS' Glenn Schuck reported.

The boy's uncle said she didn't have to do that. "She had family, we have a good family. She could have given to us - we would have took care of him."

There is a glowing memorial outside the home, Schuck reported.
