Man, 30, found fatally shot in front of Staten Island daycare

NEW YORK (1010 WINS) -- Police are investigating the fatal shooting of a man on Staten Island.

Officials responded to a report of a person assaulted on Tuesday at approximately 8:40 p.m., in front of a residential daycare center at 137 Osgood Avenue. 

Upon arrival, officers discovered 30-year-old David Pena with several gunshot wounds to the torso.

EMS transported Pena to Richmond University Medical Center where he was pronounced deceased.

The victim was found sprawled out on the ground, with a gun next to him, the Daily News reports. 

Police found no shell casings nearby and don't believe the gun that was found to be the murder weapon, the report says.

There are no arrests and the investigation is ongoing.
