Father in 1-year-old twins hot car death appears in court

NEW YORK (1010 WINS) – The case of a father whose 1-year-old twins died after being left in a hot car was delayed again after he returned to court on Tuesday.

Juan Rodriguez, 39, was charged with leaving his twins, Phoenix and Luna Rodriguez in his car for eight hours in July.

His case was delayed until Oct. 24.

He told police he forgot to drop his children off at daycare when he went to work.

He faces potentially two counts of manslaughter and two counts of negligent homicide but has not been indicted yet.

Rodriguez’s defense attorney said during a press conference Tuesday, "We do not believe, based upon Mr. Rodriguez's actions, based upon his life history, based upon his family, based on his relationship, based on all he's done, that this is a crime at all."

Rodriguez is a social worker and Army veteran who served in Iraq.
