PHILADELPHIA (1010 WINS) -- From civil suit to criminal case.

There's word that the New Jersey couple accused of stealing much of the $400,000 they raised for a homeless veteran could be indicted.

The attorney representing Katelyn McClure and Mark D'Amico in a civil case has sent a letter to the Burlington County prosecutor saying a criminal indictment is likely and that his firm will no longer represent the couple.

It's not clear if he'll be involved in any criminal case.

The pair set up a Go Fund Me campaign after Johnny Bobbitt gave McClure $20 when she ran out of gas.

The couple denies stealing the money, but said they withheld much of it because Bobbitt is a drug addict.

Meanwhile, all of the money is said to be gone, and the judge in the civil case has ordered sworn statements to figure out what happened.

D'Amico was also arrested Monday night in Florence Township on an outstanding traffic warrant.
