Artie Lange avoids jail despite failing drug test on day of court appearance

NEWARK, N.J. (1010 WINS) -- Despite a positive drug test, comedian Artie Lange has avoided jail.

NJ.com reports, Lange was in court on Friday, when Judge Nancy Sivilli directed him to a drug court. If he isn't accepted into the program, then he'll once again face the possibility of time behind bars.

Before the judge issued her decision, Lange was ordered to take a drug test, which he failed. The comedian tested positive for cocaine, amphetamine, benzodiazepines, and Suboxone. Frank Arleo, Lange's attorney, said he had prescriptions for pain medication and Suboxone.

Prosecutors pointed out that a positive test for cocaine meant Lange had to have used it within the past two days.

"It's in my system. It shouldn't be," Lange said. "Heroin is out of my life."

Lange had more than one positive drug test in October, and has faced the very real possibility of jail time. He did a short sting in rehab earlier this year.

“He keeps doing Band-Aid-type remedies for himself,” Assistant Prosecutor Tony Gutierrez said,

Lange was sentenced to four years probation in June as a result of a May 2017 arrest. State troopers pulled him over with a reported 81 decks of heroin on the Garden State Parkway.

Lange left Lancaster County, Pennsylvania rehab facility 'Retreat' twice to perform standup in Cherry Hill and New Brunswick. He was joined in court by his sister Stacey and Thomas Garofola, the marketing officer for Retreat.

NJ.com reports Lange has had surgery on his nose due to years of snorting both cocaine and heroin, and once snorting glass while trying to snort OxyContin.
